These Terms & Conditions ("Terms") govern your access to and use of Bharatneo.com, including all information, products, digital services, webinars, memberships, events, applications, features, and related services made available by Bharat Neo.

By accessing or using the Website, creating an account, registering for any webinar or event, making any payment, or otherwise using any service offered by Bharat Neo, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, our Privacy Policy, Disclaimer, Refund & Cancellation Policy, Shipping Policy, and any other policies published on the Website.

If you do not agree with these Terms, you should immediately discontinue the use of the Website and our services.

These Terms constitute an electronic record in accordance with the provisions of the Information Technology Act, 2000, the rules framed thereunder, and any amendments thereto.

This electronic record is generated by a computer system and does not require any physical or digital signature.

2. Eligibility

The services offered through the Website may include, but are not limited to:

  • Buyer registration and verification;

  • Community formation and demand aggregation;

  • Educational webinars and workshops;

  • Digital memberships and participation programs;

  • Property discovery and information services;

  • Buyer-developer engagement initiatives;

  • Request for Proposal (RFP) facilitation;

  • Digital access credentials, participation tokens, certificates, or passes;

  • Market insights and educational content; and

  • Other technology-enabled services introduced from time to time.

Unless expressly stated otherwise, Bharat Neo does not own, develop, construct, market, or sell any real estate project.

4. Platform Role

Bharat Neo operates as an independent technology platform that facilitates interactions between prospective homebuyers and participating developers through structured demand aggregation and digital engagement.

The Company follows a buyer-first value creation approach aimed at helping participating buyers obtain improved commercial outcomes through collective participation and structured negotiations.

Under separate commercial arrangements with participating developers or other ecosystem participants, Bharat Neo may receive service fees, marketing fees, facilitation charges, success-based fees, or other commercial consideration for services rendered.

Such commercial consideration is generally earned only after Bharat Neo has successfully facilitated negotiated savings or other measurable commercial benefits for participating buyers.

However, users acknowledge and agree that:

  • Bharat Neo does not guarantee that any particular savings, discounts, commercial benefits, or pricing advantages will be available in every transaction.

  • The availability and extent of any savings depend upon several factors, including market conditions, developer participation, project availability, buyer eligibility, financing, commercial negotiations, and applicable laws.

  • Bharat Neo does not determine property prices or compel developers to accept any offer.

  • Bharat Neo is not a party to any Agreement for Sale, Sale Deed, Conveyance Deed, or any other agreement executed between a buyer and a developer.

All decisions relating to property selection, booking, pricing, allotment, financing, agreement execution, registration, possession, warranties, maintenance, and post-sale obligations shall remain exclusively between the buyer and the respective developer.

5. No Agency Relationship

Nothing contained in these Terms, nor any interaction through the Website, shall be construed as creating any agency, partnership, joint venture, employment, fiduciary, representative, brokerage, franchise, or similar legal relationship between Bharat Neo and any user, developer, bank, financial institution, consultant, or other third party unless expressly agreed in writing.

Bharat Neo acts solely within the scope of the services offered through its technology platform and does not act as the authorized representative or legal agent of any buyer, developer, or other third party, except where expressly agreed under a separate written agreement.

6. User Registration and Account

Certain services offered on the Website may require registration.

By registering, you agree to:

  • Provide complete, accurate, and current information.

  • Maintain and promptly update your information whenever necessary.

  • Maintain the confidentiality of your login credentials.

  • Accept responsibility for all activities carried out under your account.

  • Notify Bharat Neo immediately if you suspect any unauthorized access or misuse of your account.

Bharat Neo reserves the right to suspend, restrict, or terminate any account where false, misleading, inaccurate, incomplete, or fraudulent information has been provided.

7. Webinars, Digital Products and Online Services

The Website may provide access to:

  • Training programmes;

  • Community meetings;

  • Digital memberships;

  • Participation passes;

  • Gateway Access Keys;

  • RFP Tokens;

  • Digital certificates;

Bharat Neo reserves the right to modify, postpone, reschedule, substitute speakers, or cancel any webinar, programme, or event due to operational, technical, legal, or other reasonable circumstances.

8. Payments

Certain products or services offered through Bharatneo.com may require payment.

All online payments shall be processed through authorised third-party payment gateway providers.

By making a payment, you authorize Bharat Neo and its payment partners to process your transaction using the payment method selected by you.

Bharat Neo does not store your complete credit card, debit card, UPI credentials, net banking passwords, or other sensitive payment instrument information.

While Bharat Neo makes reasonable efforts to ensure secure payment processing, the Company shall not be responsible for any payment failures, delays, reversals, duplicate transactions, banking errors, gateway downtime, internet disruptions, or technical failures beyond its reasonable control.

Users are responsible for ensuring that the payment information provided by them is accurate and that they are duly authorized to use the selected payment instrument.

Successful payment does not automatically guarantee eligibility for every programme, offer, or opportunity, where additional verification or qualification requirements may apply.

9. Refunds and Cancellations

Refunds, cancellations, payment reversals, and related matters shall be governed exclusively by Bharat Neo's Refund & Cancellation Policy, as published on the Website and amended from time to time.

By making any payment through Bharatneo.com, you acknowledge that you have read and agreed to the applicable Refund & Cancellation Policy.

Where a refund is approved, it shall ordinarily be processed through the original mode of payment within the timelines prescribed by the relevant payment gateway, banking partner, or applicable law.

Bharat Neo reserves the right to decline refund requests that do not satisfy the conditions specified in its Refund & Cancellation Policy.

10. Collective Savings and Demand Aggregation

Bharat Neo is founded on the principle of enabling prospective homebuyers to collectively engage with participating real estate developers through structured demand aggregation.

The objective of this process is to facilitate improved commercial outcomes, which may include negotiated pricing, value-added benefits, promotional offers, or other commercial advantages that may become available as a result of collective buyer participation.

By using the Website, you acknowledge and agree that:

  • Participation in any buyer community, cluster, campaign, webinar, or demand aggregation initiative does not guarantee that a transaction will occur.

  • Bharat Neo does not guarantee that any specific discount, savings, incentive, upgrade, waiver, or commercial benefit will be available.

  • Any commercial benefit offered by a participating developer shall remain entirely at the discretion of the respective developer and shall be subject to the developer's commercial policies, inventory availability, applicable laws, and project-specific conditions.

  • The extent of any negotiated benefit may vary from one project, developer, city, or transaction to another.

  • Bharat Neo reserves the right to modify, suspend, discontinue, or restructure any demand aggregation initiative without prior notice whenever reasonably required for operational, legal, commercial, or technical reasons.

11. Property Information

Property information displayed or communicated through Bharatneo.com, including but not limited to:

  • Project details;

  • Pricing;

  • Floor plans;

  • Layouts;

  • Amenities;

  • Possession timelines;

  • Government approvals;

  • RERA registration details;

  • Images;

  • Videos;

  • Payment plans;

  • Brochures; and

  • Marketing material,

may be obtained from participating developers or other third-party sources.

While Bharat Neo endeavors to publish information that is reasonably accurate and current, Bharat Neo does not independently verify every representation made by participating developers and does not warrant or guarantee the completeness, accuracy, reliability, or currency of such information.

Users are solely responsible for conducting their own independent verification, including legal, financial, technical, and commercial due diligence before making any booking or investment decision.

12. User Responsibilities

Every User agrees to:

  • Use the Website only for lawful purposes.

  • Provide accurate, complete, and current information.

  • Maintain the confidentiality of login credentials.

  • Ensure that all documents, declarations, and information submitted to Bharat Neo are genuine and accurate.

  • Independently verify every property before making any purchase decision.

  • Decisions made by developers, financial institutions, or other third parties;

  • Delay, interruption, suspension, or discontinuance of any service;

  • Technical failures, software defects, server downtime, internet disruptions, cyber incidents, or events beyond Bharat Neo's reasonable control;

  • Payment gateway failures, banking network issues, payment reversals, or transaction delays;

  • Any negotiations or commercial arrangements between users and developers; or

  • Any property transaction entered into between a buyer and a participating developer.

Nothing contained in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law.

20. Indemnification

You agree to indemnify, defend, and hold harmless Bharatneo Infratech Private Limited, its promoters, directors, officers, employees, affiliates, consultants, agents, licensors, successors, and assigns from and against any and all claims, demands, actions, proceedings, liabilities, losses, damages, penalties, costs, expenses, or reasonable legal fees arising out of or relating to:

  • Your breach of these Terms;

  • Your misuse of the Website or any services;

  • Your violation of any applicable law or regulation;

  • Any false, inaccurate, misleading, or fraudulent information or documents submitted by you;

  • Your infringement of the intellectual property, privacy, or other legal rights of any person; or

  • Any dispute arising between you and any third party as a consequence of your use of the Website.

23. Force Majeure

Bharat Neo shall not be liable for any delay, interruption, or failure in the performance of its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters;

  • Floods;

  • Earthquakes;

  • Fire;

  • Pandemic or epidemic;

  • War;

  • Civil unrest;

  • Terrorist acts;

  • Government restrictions or regulatory actions;

  • Labour disputes;

  • Power failures;

  • Internet outages;

  • Cyberattacks;

  • Failure of telecommunications services;

  • Banking system failures;

  • Payment gateway disruptions; or

  • Failure of third-party service providers.

Performance of the affected obligations shall be deemed suspended for the duration of the force majeure event.

25. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

26. Dispute Resolution and Jurisdiction

The parties shall endeavour to resolve any dispute, controversy, or claim arising out of or relating to these Terms through good-faith discussions.

If such dispute cannot be resolved amicably within a reasonable period, it shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.

Nothing contained herein shall restrict Bharat Neo from seeking interim or injunctive relief before any court of competent jurisdiction where necessary to protect its rights or intellectual property.

27. Severability

If any provision of these Terms is held by a competent court or authority to be invalid, illegal, or unenforceable, such provision shall be deemed severed to the extent necessary, and the remaining provisions shall continue in full force and effect.

28. Waiver

No failure, delay, or omission by Bharat Neo in exercising any right, power, or remedy under these Terms shall operate as a waiver of such right, power, or remedy.

Any waiver shall be effective only if made expressly in writing by Bharat Neo.

29. Assignment

You may not assign, transfer, delegate, or otherwise dispose of any of your rights or obligations under these Terms without the prior written consent of Bharat Neo.

Bharat Neo may assign or transfer its rights and obligations under these Terms to any affiliate, successor, purchaser, or other entity as part of a merger, acquisition, corporate restructuring, or transfer of business, subject to applicable law.

30. Entire Agreement

These Terms, together with the following documents published on Bharatneo.com, constitute the entire agreement between you and Bharatneo Infratech Private Limited concerning your access to and use of the Website:

  • Refund & Cancellation Policy;

  • Shipping Policy; and

  • Any additional policy, guideline, or legal notice published by Bharat Neo from time to time.
